1. Acceptance of Terms
By accessing or using the Neylak platform ("Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. These terms apply to all users, including customers, artists, and visitors.
2. Description of Services
Neylak is a beauty marketplace connecting customers with professional beauty artists for bookings, products, and events. We provide a platform for service discovery, appointment booking, e-commerce, and community engagement. Neylak is not responsible for the quality, timing, or outcome of services delivered by independent artists.
3. User Accounts
You must create an account to access most features. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information during registration.
4. Booking & Cancellation Policy
Bookings are subject to artist availability and confirmation. A deposit (typically 50% of service price) may be required to secure an appointment. Cancellations made at least 24 hours before the scheduled appointment may receive a full refund of the deposit. Cancellations made with less than 24 hours' notice forfeit the deposit unless otherwise agreed with the artist. Neylak reserves the right to facilitate disputes between customers and artists.
5. Payments & Fees
Payments are processed securely through Stripe. Neylak charges a platform fee on bookings, which varies by subscription plan (Free: 5%, Premium: 2.5%, Business: 0%). Product prices are as listed. All prices are in USD unless otherwise stated. Taxes may apply based on your location.
6. Subscriptions
Subscription plans are billed on a recurring basis (monthly or annually) as selected. You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Neylak reserves the right to modify plan pricing with 30 days' advance notice.
7. Gift Cards
Neylak gift cards are non-refundable and cannot be exchanged for cash. They are valid for 12 months from the date of purchase. Unused balances expire after this period. Neylak is not responsible for lost or stolen gift card codes. Gift cards cannot be used to purchase other gift cards.
8. Artist Obligations
Artists using the platform must maintain accurate service listings, honor confirmed bookings, and comply with all applicable professional licensing requirements. Artists represent that they have the right to offer their services and that those services comply with all local laws.
9. Prohibited Conduct
You agree not to: use the platform for fraudulent purposes; post false or misleading content; harass or abuse other users; circumvent the platform to arrange off-platform payments; reverse-engineer any part of the service; or violate any applicable laws.
10. Intellectual Property
All content on the Neylak platform, including logos, text, images, and software, is owned by or licensed to Neylak, Inc. You may not reproduce, distribute, or create derivative works without our written permission. User-generated content (reviews, photos) remains owned by the user but grants Neylak a license to display it on the platform.
11. Privacy
Your use of the platform is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand our data practices.
12. Limitation of Liability
To the maximum extent permitted by law, Neylak shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability to you for any claim arising from or related to these Terms shall not exceed the amounts paid by you to Neylak in the 12 months preceding the claim.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States. Any disputes shall be resolved through binding arbitration in accordance with the AAA Commercial Arbitration Rules.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the platform. Continued use of the platform after the effective date of changes constitutes acceptance of the updated Terms.
